1. Who we are and what we provide

BizKitBoom ("we", "us") provides branding, design, website development and launch-planning services for local service businesses in the United States. We sell business concepts as fixed-scope service packages. We are not a franchise, business broker, law firm or accounting firm.

2. No guarantee of business results

We do not guarantee revenue, profitability, customer acquisition, licensing approval or business success. You remain solely responsible for registering, licensing, operating and financing your own independent business.

3. Concepts and exclusivity

• Exclusive concepts are sold once and developed for a single client. Starting checkout reserves an exclusive concept for 30 minutes; a paid deposit keeps it reserved; full payment marks it sold.
• Customizable concepts share an underlying structure but every delivered brand is unique to its client.
• Repeatable concepts may be licensed to multiple operators in different markets.

4. Payments

All prices are in U.S. dollars. Eligible projects may begin with a 30% deposit; the remaining balance is due before final files are released. Payments are processed by our payment provider - we never store card details on our servers.

5. Project process and client obligations

Standard delivery is planned for 20 business days after (a) payment, (b) completion of the client brief and (c) delivery of all required materials. Delays in providing the brief, feedback or materials extend the timeline accordingly. Each package includes two structured revision rounds; additional rounds are available as paid add-ons.

6. Intellectual property

Upon full payment, the final delivered brand assets are assigned to you for use in your business. We retain the right to display completed work in our portfolio unless agreed otherwise in writing. Concept structures, internal processes and undelivered drafts remain our property.

7. Refunds

Refund eligibility depends on project stage and is described in our Refund Policy, which forms part of these terms.

8. Acceptable use

You may not use our services for unlawful businesses, misleading offers or content that infringes third-party rights. We may decline or cancel projects that violate this section, with refunds handled per the Refund Policy.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the services is limited to the amount you paid for the package concerned. We are not liable for indirect or consequential damages, including lost profits.

10. Governing law and disputes

These terms are governed by the laws of {{company.jurisdiction}}, without regard to conflict-of-law rules. Any dispute that cannot be resolved directly will be brought before the courts with jurisdiction over {{company.address}}. Nothing here removes a consumer protection you hold under the law of your own state of residence.
